Article 1: General provisions
The e-commerce website of Skin Secrets, with registered office at 9990 Maldegem, Bezembindersstraat 8, offers its customers the opportunity to purchase the products from its web shop online.
These Terms and Conditions ("Conditions") apply to every order placed by a visitor to this e-commerce website ("Customer"). When placing an order via the Skin Secrets webshop, the Customer must expressly accept these Terms and Conditions, thereby agreeing to their applicability to the exclusion of all other terms and conditions. Additional terms and conditions of the Customer are excluded, except when previously, in writing and expressly accepted by Skin Secrets.
Article 2: Price
All prices stated are expressed in EURO, always including mandatory taxes or duties to be borne by the Customer.
If delivery, reservation or administrative costs are charged, this will be stated separately.
The indication of price refers exclusively to the articles as described verbatim. The accompanying photos are for decorative purposes and may contain elements not included in the price.
Offers and prices are indicated in euros and are valid only on the date the order is placed. They may be changed at any time, without prior notice.
Rate reductions or other promotional offers indicated on the packaging of the products ordered are already included in our sales prices listed on our website.
Only the price indicated on the site is valid between the contracting parties. The prices indicated at the end of the ordering process indicate the total prices, including all taxes, as well as delivery and any other costs.
Article 3: Offer
Despite the fact that the online catalogue and the e-commerce website are compiled with the greatest possible care, it is still possible that the information offered is incomplete, contains material errors, or is not up-to-date. Obvious mistakes or errors in the offer do not bind Skin Secrets.
If the Customer has specific questions about e.g. availability, delivery time or delivery method, we request the Customer to contact us in advance.
The offer is always valid while stocks last and may be modified or withdrawn by Skin Secrets at any time. Skin Secrets cannot be held liable for the unavailability of a product. If an offer has a limited period of validity or is made subject to conditions, this will be explicitly stated in the offer.
Article 4: Online purchases
Each order placed on the Site follows several steps: each step is completed successively by the "click" of a confirmation icon.
The ordering process follows a logical and transparent path that you can see thanks to a layout and graphic design provided for this purpose.
When you click on an icon whose designation or presentation entails a commitment that any Internet user can understand, you are bound by your click. This is the case, for example, for icons named "Place order", "Payment" or similar designations.
The ordering process gives the opportunity to correct errors.
The ordering process allows you to easily understand which payment methods are accepted, which delivery methods are proposed and their costs.
By clicking on the "Pay" button, you place a firm order of the items in your shopping cart. Confirmation of receipt of the order occurs immediately upon receipt of the order. This confirmation of receipt of the order does not constitute a binding acceptance of the order.
The Customer has the choice between the following payment methods
- by bank card
- via banking app
Skin Secrets is entitled to refuse an order due to a serious shortcoming of the Customer in relation to orders involving the Customer.
Article 5: Delivery and execution of the agreement
The purchase agreement is concluded by sending an e-mail of shipment confirmation of the order. This e-mail will be sent within four working days after We have received your order.
You undertake to check whether you have received this e-mail of shipment confirmation of the order in your mailbox, if necessary also in the spam folder or junk folder.
Once the e-mail confirming dispatch of the order has been sent, we undertake to deliver the goods to the delivery address specified during the ordering process.
Delivery of the Good shall be made in a package, by post, through the intervention of a transport company engaged by Us at the delivery point You have indicated to Us.
Delivery times are generally 2 to 5 working days unless specifically stated otherwise on the Site or in cases of force majeure.
You will be informed of any delivery restrictions/problems at the latest at the beginning of the ordering process.
Our deliveries are free from a certain amount indicated on the Site at the time of the order (after deduction of the purchase/discount vouchers and before application of the delivery costs). For all other orders, delivery costs are invoiced in accordance with the information indicated on the Site at the time of the order. Any risk of loss or damage to the Goods is transferred to You upon Your taking delivery of the Goods, i.e. You, or a third party designated by You who is not the carrier, physically taking delivery of the Goods.
Any complaints relating to a defect of the Goods delivered, an inaccuracy in quantities or an incorrect reference with respect to the order confirmed on the Site must be reported upon receipt of the Goods to the address listed under the ''company details'' of these general terms and conditions.
This clause does not affect the right of withdrawal and the statutory warranties you enjoy, if any, in accordance with these terms and conditions.
Items ordered via this web shop are delivered in Belgium and the Netherlands.
Article 6: Retention of title
The delivered items will remain the exclusive property of Skin Secrets until full payment by the Customer.
The Customer undertakes to point out the retention of title of Skin Secrets to third parties if necessary, e.g. to anyone who might come to seize items not yet paid for in full.
Article 7: Right of withdrawal
The provisions of this article apply only to Customers who purchase items online from Skin Secrets in their capacity as consumers.
The Customer has the right to revoke the agreement within a period of 14 calendar days without giving reasons.
The withdrawal period expires 14 calendar days after the day
on which the Customer or a third party designated by the Customer, who is not the carrier, takes physical possession of the good."
To exercise the right of withdrawal, the Customer must inform Skin Secrets, Bezembidnersstraat 8, 9990 Maldegem, tel: 0498 21 15 82, info@skinsecrets.be; of its decision to withdraw from the agreement by an unequivocal statement (e.g. in writing by post, fax or e-mail). The Customer may use the attached model withdrawal form for this purpose, but is not obliged to do so.
To comply with the withdrawal period, the Customer must send his communication concerning his exercise of the right of withdrawal before the withdrawal period has expired.
The Customer must return or hand over the goods to Skin Secrets, Bezembindersstraat 8 at 9990, Maldegem, without delay, but in any event no later than 14 calendar days after the day on which he communicates his decision to revoke the agreement to Skin Secrets. The Customer is in time if he returns the goods before the period of 14 calendar days has expired.
The direct costs of returning the goods shall be borne by the Customer.
If the returned product is diminished in value in any way, Skin Secrets reserves the right to hold the Customer liable and claim compensation for any diminution in the value of the goods resulting from the Customer's use of the goods beyond what is necessary to establish the nature, characteristics and operation of the goods.
Only items in their original, sealed packaging, together with all accessories and invoice or proof of purchase can be taken back.
If the Customer revokes the Agreement, Skin Secrets shall refund all payments received from the Customer up to that point, including standard delivery charges, to the Customer within a maximum of 14 calendar days of Skin Secrets being notified of the Customer's decision to revoke the Agreement. In the case of sales contracts, Skin Secrets may delay repayment until it has received all the goods back, or until the Customer has demonstrated that it has returned the goods, whichever comes first.
Any additional costs resulting from the Customer's choice of a mode of delivery other than the cheapest standard delivery offered by Skin Secrets will not be refunded.
Skin Secrets will refund the Customer using the same means of payment with which the Customer made the original transaction, unless the Customer has expressly agreed otherwise; in any event, the Customer will not be charged for such refunds.
The order of the following Goods does not give a right of withdrawal:
- The Goods whose seal is broken or damaged after delivery and which cannot be returned for hygienic or health protection reasons;
- Goods manufactured to your specifications or clearly personalised;
- Goods that may spoil quickly or whose expiry date could be passed quickly.

Article 9: Penalties for non-payment
Without prejudice to the exercise of other rights available to Skin Secrets, in the event of non-payment or late payment, the Customer shall automatically and without notice be liable to pay interest of 10% per annum on the unpaid amount from the date of default. In addition, the Customer shall be liable, ipso jure and without notice, to pay a lump-sum indemnity of 10% on the amount concerned, with a minimum of €25 per invoice.
Without prejudice to the foregoing, Skin Secrets reserves the right to take back items not paid for (in full).

Article 12: Infringement of validity - non-violation
If any provision of these Terms is declared invalid, illegal or void, this shall in no way affect the validity, legality and applicability of the other provisions.
Failure at any time by Skin Secrets to enforce any of the rights enumerated in these Terms, or to exercise any right hereunder, shall never be deemed a waiver of such provision and shall never affect the validity of such rights.
Article 13: Modification of conditions
These Terms and Conditions are supplemented by other terms and conditions expressly referred to, and Skin Secrets' general terms and conditions of sale In case of conflict, these Terms and Conditions take precedence.
Article 14: Evidence
The Customer accepts that electronic communications and backups may serve as evidence.
Skin Secrets has endorsed the Regulations of the UNIZO e-commerce label. A copy of these Regulations and access to UNIZO's complaints procedure is available at http://www.unizo.be/ecommercelabel/.
Article 15: Applicable law - Disputes
Belgian law applies, with the exception of the provisions of private international law on applicable law.
The courts of the Consumer's place of residence have jurisdiction in the event of legal disputes. The Consumer may also turn to the ODR platform (http://ec.europa.eu/consumers/odr/).
